Privacy Policy

1. Introduction

At Shout, we take your privacy seriously. This Privacy Policy covers Shout’s treatment of personal data (“Personal Data”) and other data that Shout gathers when you are using and/ or accessing the services, features, content and applications provided by Shout (“Service” and/ or “Services”). Except if stated to the contrary, all terms and definitions in this Privacy Policy shall have the same meaning as outlined in Shout’s Terms of Use. Shout Platform Ltd, with its registered office at Tech Incubator, Oxford Road, Manchester, Oxford Road, Manchester, M1 7ED, United Kingdom, with registered number 09459393, shall be deemed as data controller.

2. Children

The Services are not directed to individuals who are younger than 13 years old. We do not knowingly collect information from children under 13. If we become aware that a child under 13 has provided us with personal information without parental consent, we will work to remove said information and the account.

3. How we collect your Personal Data

3.1 Personal Data from you

We receive, collect and store information you enter on our Services or provide to us in any other way. The types of Personal Data collected (with your explicit consent) include your name, e-mail address, phone number, date of birth, gender, password in an encrypted format, languages you speak, your current geolocation (“Personal Information”); and any text, images, graphics and related data (“Content”) that you provide through the Service. We use your Personal Information, among other things, to enable you to set up a user account and profile that can be used to interact with other users through the Services; to enable you to publish content to the Services; to improve the content of the Services; and to communicate special announcements and new features. Your Services account will be associated with a Services ID, your e-mail and phone number (when you log into the Services), and this account will be used for all of our Services that you use.

3.2 Personal Data from Use of Service

3.2.1 Activity

We may store information about your use of the Services, such as your search activity, the Content and user profiles you view and the date and time of your Service activities (such as login). We also may store information that your computer or mobile device provides to us in connection with your use of the Service, such as your browser type, type of computer or mobile device, browser language, IP address, phone number, unique device identifier (which is part of the mobile application instance and is therefore permanently deleted from the device when the application is uninstalled), geolocation (obtained either via satellite positioning or device’s operating system) and requested and referring URLs.

Information you provide to one of our Services may be used with other Services you use. For example, geolocation information we receive in connection with your use of our iOS mobile application may be used to customise the content you see on other mobile and web applications. Additionally, the information you provide when using the Services in an unregistered state may be later used during the registration of an account.

3.2.2 Information about your Location

Shout and the Services we provide to you are of a location-based nature. In order to enhance the value and relevance to you as our user, Shout needs to know your current geolocation. Such information is NOT shared with other users and/ or third-parties, unless you explicitly publish Content in a given geolocation. When you open our mobile application and/ or use our Services, we use the geolocation information from your mobile device or web browser (e.g. latitude and longitude) to adapt and focus our Services based on the provided geolocation. For example, we may emphasise to you nearby locations, events and businesses. If you write a comment, publish Content or otherwise interact with a place, users may infer that you have been to that location. In addition, some of this Content, such as posts and comments, are time stamped and other users could use that information to infer when you were at a place, even though Content and comments can be posted when you aren’t at a given place.

Shout mobile application will explicitly ask for permission before it uses your location data for the first time. You can revoke the application’s access to your location at any time via operating system’s Settings.

3.2.3 Other Information collected automatically

Shout automatically receives and records information on our server logs from your web browser or mobile application when you access and/ or use our Services. This may include your geolocation, IP address, web browser type, operating system version, application version, unique device identifier (which is part of the mobile application instance and is therefore permanently deleted from the device when the application is uninstalled), cookie information, information regarding your use of our Services and the page and/ or Content you requested. We automatically receive your geolocation when you use the Services. We use various technologies to determine your current location, such as satellite positioning or location services provided by the operating system of the device you use.

3.3 Personal Data from Third Parties

The Content provided to you by the Services may contain links to other websites. For the avoidance of doubt, Shout is not responsible for the privacy policies and/ or practices on other websites. When linking or navigating to another website, you should read the privacy policy stated on that website.

4. How we use your Personal Data

The value and usefulness of Shout and the Services we provide are based on the information about our users. Therefore, we use your Personal Data in a number of ways as outlined below. We use your Personal Data for providing, maintenance, security and improving our Services, for developing new services and for the protection of Shout and its users. We use your Personal Data also with the aim of providing content relevant to you. We do NOT lease, sell or otherwise provide your Personal Data to third-parties.

One of the primary purposes of Shout and/ or our Services is to enable users to learn about businesses, locations, events and brands that are relevant to them, and for these entities to provide information about themselves, their locations and events to Shout users, as well as to reward users when they visit their location or event through offers and specials.

5. Public Information

The information and Content that you contribute through the Service is intended for public consumption, including your posts, images, likes, comments and public information in your user profile. We may display this information through the Service to other users and/ or businesses. This information may be also accessible by internet search engines.

6. Security of your Personal Data

Your Shout user account is protected by password. It is within your responsibility to prevent unauthorised access to your account and Personal Data by choosing a strong password and protecting it.

7. Use of Cookies

Shout may use HTTP protocol cookie information (“Cookies”) in connection with your use of the Services, whether you use the Services via mobile application or web browser. Cookies may have unique identifiers, and reside, among other places, on your computer, mobile device, or on our Services. Cookies may transmit information about you and your use of the Service. Cookies may be persistent or stored only during an individual session. You consent to our use of Cookies by expressing explicit and informed consent with their use (active click to consent, i.e. opt-in) once you first use our Services through your computer or mobile device.

We may use Cookies in our Services for several reasons:


Processes - We try to make the Service work in the way you expect.
Authentication, Security, and Compliance – We strive to prevent fraud, protect your data from unauthorised parties, and comply with legal requirements.
Preferences – We want to remember information about how you prefer the Service to behave and look.
Analytics – Cookies help us understand how visitors use the Service, which gives us intelligence to improve our App and/ or Services.

8. Investigations

We may investigate and disclose information from or about you if we have a good faith belief that such investigation or disclosure is either reasonably necessary to comply with law, or protects our rights, reputation, property, or that of our users, affiliates, or the public.

9. Access and Updates to your Personal Data

Whenever you use our Services, we aim to provide you with access to your Personal Data. If that information is wrong, we strive to give you ways to update it quickly or to request to delete it – unless we have to keep that information for legitimate business or legal purposes. When updating your Personal Data, we may ask you to verify your identity before we can act on your request.

We may reject requests that are unreasonably repetitive, require disproportionate technical effort (for example, developing a new system or fundamentally changing an existing practice), risk the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup systems).

Where we can provide information access and correction, we will do so free of charge, except where it would require a disproportionate effort. We aim to maintain our services in a manner that protects information from accidental or malicious destruction. Because of this, after you delete information from our Services, we may not immediately delete copies from our backup systems. Such deletion from backup systems will be performed within a maximum of two weeks.

10. Data protection within the European Union

At all times, we process your Personal Data in accordance with the EU law, including (but not limited to) the General Data Protection Regulation (EU) 2016/679.

11. Account Termination

You can delete your Shout user account via the functionality provided in our mobile application at any time. Even after you delete your account, we may retain certain Personal Data for the purposes authorised under this Privacy Policy unless prohibited by law.
You can also remove/ change Content or information that you have added/ posted on the Services via your account. Even after you remove information from your account or profile, copies of that information may remain viewable elsewhere, to the extent it has been shared with other users, or it was copied or stored by other users.

12. Changes to this Privacy Policy

We may change this Privacy Policy from time to time. The most current version of the Privacy Policy will govern our collection, use, and disclosure of your Personal Data. If we make material changes to this Privacy Policy, we will notify you by e-mail or by posting a notice on the Service prior to the effective date of the changes. By continuing to access or use the Service after those changes become effective, you agree to the revised Privacy Policy.
